By purchasing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Acceptance of Terms

By accessing our website, purchasing an eSIM, or using any of our services ("Services"), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. These Terms apply to all visitors, users, and purchasers of our Services.

You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are accessing the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

2.1 Service Overview

VNSH provides ephemeral eSIM (embedded SIM) services that provide temporary mobile data connectivity. Our Services are characterized by:

  • Data-Only Service: Our eSIMs provide mobile data connectivity only. Voice calling and SMS messaging are NOT included.
  • Fixed Duration: Each eSIM is activated for a pre-selected duration (e.g., 1 day, 7 days, 30 days) and automatically deactivates upon expiration.
  • Non-Renewable: eSIMs cannot be renewed, extended, or reactivated after expiration.
  • Data Limits: Each plan includes a specified data allowance. Service terminates when either the duration expires OR the data allowance is exhausted, whichever occurs first.

2.2 Service Limitations

You acknowledge and accept the following limitations:

  • Coverage depends on partner carrier networks and may vary by location
  • Network speeds are not guaranteed and depend on local network conditions
  • Some services, applications, or websites may be inaccessible in certain regions due to local restrictions
  • eSIM compatibility depends on your device; not all devices support eSIM technology

No Voice or SMS: Our Services provide DATA ONLY. There is no voice calling, SMS texting, or phone number associated with our eSIMs. Do not purchase our Services expecting these features.

3. Purchases and Payment

3.1 Pricing and Payment

All prices are displayed in US Dollars (USD). Payment is accepted via cryptocurrency (Bitcoin and Monero) through third-party payment processors. Prices are subject to change without notice; however, confirmed orders will be fulfilled at the displayed price at time of purchase.

3.2 Order Fulfillment

Upon successful payment confirmation, you will receive an eSIM activation QR code. You are responsible for:

  • Ensuring your device is eSIM-compatible before purchase
  • Scanning and installing the eSIM promptly after receipt
  • Properly configuring your device settings

3.3 No Refunds Policy

ALL SALES ARE FINAL. NO REFUNDS WILL BE PROVIDED.

Due to the nature of our Services (instant digital delivery, privacy-preserving architecture, automatic data purge), we cannot verify claims or process refunds. This policy applies regardless of:

  • Device incompatibility
  • User error in installation
  • Unused data or time
  • Network coverage issues in your location
  • Change of mind
  • Any other reason

We strongly recommend purchasing a 1-day plan first to test compatibility with your device and coverage in your intended location before purchasing longer duration plans.

4. User Responsibilities and Acceptable Use

4.1 Lawful Use

You agree to use our Services only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations. You are solely responsible for ensuring your use of the Services complies with all laws applicable to you.

4.2 Prohibited Activities

You agree NOT to use our Services to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit malware, viruses, or harmful code
  • Engage in network abuse, including denial-of-service attacks
  • Send spam or unsolicited communications
  • Engage in activities that damage carrier network infrastructure
  • Resell or redistribute our Services without authorization
  • Circumvent or attempt to circumvent service limitations

4.3 Compliance with Carrier Terms

Our eSIMs operate on third-party carrier networks. You agree to comply with the acceptable use policies of underlying carriers, which may include restrictions on certain types of traffic or usage patterns.

5. Disclaimers and Limitation of Liability

5.1 Service Provided "As Is"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness
  • Uninterrupted or error-free service
  • Security or freedom from viruses

5.2 No Guarantee of Availability

We do not guarantee that our Services will be available at all times or in all locations. Network coverage, speed, and reliability depend on third-party carrier networks over which we have no control. Service interruptions may occur due to:

  • Carrier network issues or maintenance
  • Geographic coverage limitations
  • Technical failures
  • Force majeure events
  • Regulatory or legal requirements

5.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VNSH, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or business opportunities
  • Any damages arising from service interruption or unavailability
  • Any damages arising from unauthorized access or security breaches
  • Any damages exceeding the amount paid for the specific eSIM giving rise to the claim

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

5.4 Essential Purpose

You acknowledge that the limitations of liability in this Section 5 are an essential element of the bargain between you and us, and that we would not provide the Services without such limitations.

6. Indemnification

You agree to indemnify, defend, and hold harmless VNSH and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your violation of any third-party rights
  • Any content you transmit through the Services

7. Intellectual Property

All content, trademarks, service marks, trade names, logos, and other intellectual property displayed on our website or in connection with our Services are the property of VNSH or their respective owners. You are granted no right or license to use any intellectual property except as expressly provided in these Terms.

8. Term and Termination

8.1 Term

These Terms remain in effect for as long as you use our Services. The license to use a specific eSIM terminates upon expiration of the selected duration or exhaustion of data allowance, whichever occurs first.

8.2 Termination by Us

We reserve the right to suspend or terminate Services, without notice or liability, for any reason, including but not limited to:

  • Violation of these Terms
  • Suspected fraudulent activity
  • Abuse of network resources
  • Legal or regulatory requirements

8.3 Effect of Termination

Upon termination, your right to use the Services immediately ceases. Sections 3.3 (No Refunds), 5 (Disclaimers and Limitation of Liability), 6 (Indemnification), and 10 (Dispute Resolution) survive termination.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Services after any changes constitutes acceptance of the modified Terms.

For material changes, we will provide notice by posting a prominent announcement on our website. It is your responsibility to review these Terms periodically.

10. Dispute Resolution

10.3 Class Action Waiver

YOU AND VNSH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

10.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our primary operations are located, without regard to conflict of law principles.

11. Consumer Protection Disclosures

11.1 Material Terms Disclosure

In accordance with consumer protection requirements, we clearly disclose the following material terms:

  • Product: Data-only eSIM service (no voice or SMS)
  • Duration: Fixed, non-renewable (1, 7, or 30 days as selected)
  • Data Limit: As specified at purchase (service ends when exhausted)
  • Coverage: Depends on carrier networks; not guaranteed in all locations
  • Refunds: Not available under any circumstances
  • Renewal: Not available; new purchase required
  • Support: Limited due to privacy architecture

11.2 No Deceptive Practices

We are committed to honest and transparent business practices. All service limitations, terms, and conditions are clearly disclosed before purchase. We do not engage in:

  • Hidden fees or charges
  • Automatic renewals or recurring charges
  • Misleading advertising or false claims
  • Bait-and-switch tactics
  • Undisclosed material terms

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VNSH regarding the Services and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

12.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, carrier network failures, or internet disruptions.
